Legal Disclaimer: These Terms of Service (“Terms”) govern your use of the services provided by Michelle’s Mobile Notary and Process Server, LLC (“Company,” “we,” “us,” or “our”) and your use of our website mnotaryandprocessserver.com (the “Site”).By using our Site or booking any apostille, notary, or process serving service, you agree to these Terms.If you do not agree, please do not use our Site or services.

1. Services We Provide

We provide mobile and remote services including, but not limited to:

  • Apostille services for eligible documents

  • Notary services

  • Service of process and related legal document delivery

  • We do not provide legal advice or legal representation. Nothing on this Site or in our communications creates an attorney–client relationship.

2. Eligibility

To use our services, you must:

  • Be at least 18 years old, and

  • Be legally able to enter into binding contracts.

By using our services, you represent that all information you provide is true, accurate, and complete.

3. No Legal Advice

We are not a law firm and do not provide legal advice.Any information on this Site is for general informational purposes only and should not be relied on as legal advice.

For legal questions, you should consult a licensed attorney in your jurisdiction.

4. Service Areas

Our primary service area is Washington State.We may assist with documents originating from or destined for other states or countries, subject to applicable laws and regulations.Availability of services may vary by location and is subject to our scheduling and capacity.

5. Appointments, Cancellations & No-Shows

Appointments

  • Appointments may be required for certain services.

  • We may offer same-day or urgent services when available.

Cancellations

  • Please notify us as soon as possible if you need to cancel or reschedule.

  • We reserve the right to charge a cancellation fee for late cancellations.

No-Shows

  • If you do not appear for a scheduled appointment or are not available at the agreed location/time, a no-show fee and/or travel fee may apply.

Details of fees will be provided at the time of booking or upon request.

6. Fees & Payments

Fees & Payments are as follows (no exceptions):

  • Fees for services (including travel, rush, and after-hours fees) will be disclosed before or at the time of booking.

  • Payment is due as specified at the time of service or booking (for example, prior to service, at time of booking, or via invoice).

  • We may accept various forms of payment (such as cash, card, or electronic payment), as indicated on our Site or in our communications.

  • We Do NOT accept Personal Checks.

  • All Payments are Pre-Paid, unless otherwise agreed upon.

  • We do NOT issue refunds. No exceptions. All payments are final once received. 

We reserve the right to change our fees at any time. Changes will not affect services already booked and confirmed, unless otherwise agreed.

7. SMS Terms & Conditions

SMS Consent Communication

  • The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

Types of SMS Communications

If you have consented to receive text messages from Michelle's Mobile Notary and Process Server, LLC, you may receive messages related to the following:

  • Customer care regarding appointment reminders and confirmation, follow-up messages, and Customer inquiries

  • Marketing regarding Promotions or offers. 

  • Example: "Hello, this is a friendly reminder of your upcoming appointment with Michelle's Mobile Notary and Process Server, LLC at [Location] on [Date] at [Time]. You can reply STOP to opt out of SMS messaging from Michelle's Mobile Notary and Process Server, LLC at any time."

Message Frequency

  • Message frequency may vary depending on the type of communication. 

  • Example: "Message frequency may vary. You may receive up to 10 SMS messages per week regarding your appointments or account status."

Potential Fees for SMS Messaging

  • Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.

Opt-In Method

You may opt-in to receive SMS messages from Michelle's Mobile Notary and Process Server, LLC in the following way:

  • By submitting our Contact Us form

  • By verbal consent (telling us via phone or in-person, that you consent to receive SMS and that you have agreed to our Privacy Policy and Terms of Service) Consent will be audio recorded to meet legal standards and compliance per state and federal law. 

  • By email or other written consent (telling us via email or other form of written correspondence that you consent to receive SMS and you have reviewed and agree to our Privacy Policy and Terms of Service).

Opt-Out Method

  • You can opt out of receiving SMS messages at any time. To do so, simply reply "STOP" to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.

Additional Options

  • If you do not wish to receive SMS messages, you can choose not to check the SMS consent box on our forms, decline verbal consent, or decline email or other written consent.

  • Message and data rates may apply.

  • You can opt out at any time by texting "STOP."

8. Client Responsibilities

You are responsible for:

  • Providing valid, unexpired identification as required by law for notarial acts.

  • Ensuring documents are complete (no blank required fields) before notarization.

  • Confirming that the information in your documents is accurate and truthful.

  • Providing correct addresses and contact information for service of process.

We may refuse service if:

  • You cannot provide acceptable identification,

  • The document appears incomplete, fraudulent, or suspicious, or

  • We believe the transaction is unlawful or unethical.

9. Apostille & Processing Times

Apostille and authentication processing times depend on:

  • Government agencies,

  • Courts, and

  • Other third parties.

We cannot guarantee specific completion dates or times.
Any timeframes we provide are estimates only.
We are not responsible for delays caused by:

  • Government offices,

  • Mail or shipping carriers,

  • Incorrect or incomplete information provided by you, or

  • Events beyond our control.

10. Notary Services

Scope of Services & Personal Appearance

We provide notary services, including in-person, mobile, and Remote Online Notarization (RON).

  • In-Person/Mobile: All signers must personally appear before the Notary Public at the time of signing. Identification will be verified via valid, government-issued photo ID.

  • RON: Signers must have working audio-visual technology. The notary will perform identity verification through knowledge-based authentication and credential analysis as required by law.

  • Limitations: The Notary is prohibited from assisting in drafting, completing, or selecting legal documents.

Identification & Capacity

The signer must be able to prove their identity, be alert, and be acting of their own free will. The notary reserves the right to refuse service if the signer cannot produce proper ID, appears confused, or if the notary suspects fraud or coercion. 

Fees & Payments

  • Notary Fees: Fees are charged per signature/notarial act in accordance with state-mandated maximums.

  • Travel Fees (Mobile): A separate travel fee applies for mobile services, which is independent of the notarial fee.

  • RON Technology Fees: Additional fees may apply to cover the certified third-party RON platform usage.

Remote Online Notarization (RON) Specifics

The signer acknowledges that RON sessions are recorded, secured, and stored in compliance with state regulations. The signer must be located within the United States or its territories during the RON session.

11. Service of Process

When we provide process serving:

  • We will make reasonable, good-faith efforts to serve documents according to applicable rules and laws.

  • We do not guarantee that service will be successful in every case (for example, if a person is evading service or cannot be located).

You are responsible for:

  • Providing accurate and complete information about the person or entity to be served,

  • Providing correct addresses and any helpful details to assist with service.

We may charge additional fees for:

  • Multiple attempts,

  • Additional addresses, or

  • Special circumstances (e.g., remote locations, rush service).

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, arising out of or related to your use of our Site or services.

  • Our total liability for any claim related to our services is limited to the amount you paid us for the specific service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Michelle’s Mobile Notary and Process Server, LLC, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of our Site or services,

  • Your breach of these Terms, or

  • Your violation of any law or the rights of a third party.

14. Intellectual Property

All content on this Site, including text, logos, graphics, and images, is owned by or licensed to Michelle’s Mobile Notary and Process Server, LLC, unless otherwise noted.You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

15. Privacy

Your use of our Site and services is also governed by our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and protect your information.

16. Changes to These Terms

We may update these Terms from time to time.When we do, we will update the “Last Updated” date at the top of this page.Your continued use of our Site or services after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles.Any disputes arising out of or relating to these Terms or our services will be resolved in the state or federal courts located in Washington State, where permitted by law.
